Trade National Visa Eligibility
The U.S. Citizenship and Immigration Services (USCIS) governs trade national visas, also referred to as TN visas. The trade national visa is available for Canadian and Mexican citizens who are in certain professions, including scientists, teachers, accountants, lawyers, pharmacists, and engineers. Additionally, to qualify, individuals must have the necessary qualifications for their profession and must have a full or part time offer of employment in the U.S. in their field.
How to Apply for a Trade National Visa
The process is different for Canadian citizens than it is for Mexican citizens, so it is important to follow the correct process given your country of origin.
Canadian Citizens
Canadian citizens generally are eligible for nonimmigrant admission to the U.S., so those wishing to enter the U.S. under trade national nonimmigrant status may simply present the required documentation to a U.S. Customs and Border Protection (CBP) officer at any designated port of entry. The individual must show proof of Canadian citizenship, proof of an employment offer from the prospective employer, and proper credentials for his/her field. Alternatively, an employer may apply for trade national nonimmigrant status on behalf of a Canadian employee by filing the Form I-129 with the proper USCIS office.
Mexican Citizens
Mexican citizens must first apply for the TN visa directly at a U.S. Embassy or Consulate in Mexico. Once the visa is approved, the individual must then apply for admission to the U.S. at a designated CBP port of entry.
