Employment-Based Visas Explained

There are many different types of employment-based visas available. The U.S. Department of State provides two main categories of employment visas: non-temporary employment-based immigrant visas, and temporary worker visas.

Employment-based immigrant visas allow certain immigrant employees to apply for permanent resident status. There are 140,000 visas available annually, so it is important that qualified candidates begin their applications early and submit them timely to qualify for the specific fiscal year. Visas are awarded under the following preference category system:

  • E1: employees with extraordinary abilities in certain fields, internationally recognized professors and researchers, and multinational managers/executives;
  • E2: holders of advanced degrees or those with exceptional abilities in specific fields;
  • E3: skilled workers with two years of work or training experienced, professionals with at least a baccalaureate degree or the equivalent, and unskilled workers whose positions required less than two years of work or training;
  • E4: special immigrants who fit into one of 19 subgroups enumerated by the S. Department of State; and
  • E5: immigrant investors.

In contrast, temporary worker visas allow foreign employees to work for U.S. employers for a predetermined, temporary period of time. These are best suited for individuals who wish to work in the U.S. but do not qualify for the employment-based immigrant visa described above. There are a number of different temporary worker categories, including:

  • Workers in specialty occupations;
  • Agricultural workers;
  • Non-agricultural workers;
  • Trainees/special education visitors;
  • Intracompany transferees;
  • Employees with extraordinary abilities or achievements;
  • Athletes;
  • Artists and entertainers; and
  • Participants of cultural exchange programs.

There is an annual cap on temporary worker visas as well, and due to high demand for this visa type, the cap is reached quickly at the start of each fiscal year, so it is important to apply early.
