EB-5 Visa Requirements

The investment has to be commercial in nature, meaning it has to be for-profit. The investment amount must be at least $1 million, but for areas that are rural or have high unemployment rates, the minimum investment amount is $500,000.
It is important to note that the program is capped at 10,000 visas each year, and the cap has been reached the past several years. Accordingly, it is important to apply before the cap has been met for that fiscal year.
How to Apply for an EB-5 Visa
The first step of the process is to complete the Form I-526. Upon approval of the Form I-526, the individual must complete one of three forms based upon his/her specific circumstances: Form I-485, DS-230, or DS-260. Upon approval of the Form I-485 or after entering the U.S., the individual and her/his family members will be granted conditional permanent resident status for two years. After two years, the individual must apply to have the conditions on their residency lifted.
